When moving into a rented apartment or house in India, landlords, housing societies, and property management portals frequently request copies of identity proofs for rental lease execution and mandatory tenant police verification.

However, sharing an unredacted photocopy of your Aadhaar card exposes you to severe long-term identity theft risks. Under UIDAI notifications and Supreme Court rulings, private entities and individuals are not legally authorized to demand unmasked 12-digit Aadhaar cards.

UIDAI Regulations & Masked Aadhaar Directives

The Unique Identification Authority of India (UIDAI) explicitly authorizes and encourages the use of Masked Aadhaar for offline KYC verifications:

  1. First 8 Digits Concealed: The first eight digits are replaced with XXXX-XXXX, displaying only the final 4 digits (e.g., XXXX-XXXX-8921).
  2. Full Legal Validity: A masked Aadhaar possesses the exact same legal validity as a standard Aadhaar card for verifying name, residential address, and date of birth.
  3. Prohibition of Storage: Private landlords and real estate brokers are strictly forbidden from archiving unmasked Aadhaar numbers under Chapter VI of the Aadhaar Act, 2016.

Why You Must Scramble the Aadhaar QR Code

Many tenants believe that simply crossing out the 12-digit number with a pen or digital marker protects their identity. This is a dangerous misconception.

Every Aadhaar card contains a high-density Secure QR code containing:

  • Your full 12-digit unmasked Aadhaar number.
  • Your full name, gender, and date of birth.
  • Your complete residential address.
  • A 200 DPI JPEG photograph of your face.

Official Circulars & Gazette Notifications (India)

1. UIDAI Public Notification & CircularF.No. 4(4)/57/122/2016

Under official circulars issued by UIDAI, Masked Aadhaar (displaying only the last 4 digits) is legally valid and recognized for all identity verification purposes. Private entities like hotels, landlords, and recruiters cannot compel citizens to submit an unmasked 12-digit physical Aadhaar copy.

2. Reserve Bank of India (RBI) KYC Master DirectionSection 16 (Amended)

RBI Master Direction on Know Your Customer (KYC) mandates that regulated entities (banks, NBFCs, payment operators) collecting physical Aadhaar copies for offline verification must redact or blackout the first 8 digits to protect customer identity.

3. Digital Personal Data Protection Act, 2023Statutory Data Minimization

Under the DPDP Act 2023, citizens possess the statutory right to enforce purpose limitation and data minimization. Overwriting documents with single-use watermarks (e.g. "For Hotel Check-in Only - Date") legally binds the recipient to use the document strictly for that authorized purpose.

4. Aadhaar Act, 2016 (Amended 2019)Sections 4(3), 8A & 29(4)

Under Sections 4(3) and 8A of the Aadhaar Act, citizens may voluntarily present masked Aadhaar for offline verification, and offline verification-seeking entities are strictly prohibited from collecting or storing full Aadhaar numbers. Section 29(4) forbids public display of Aadhaar credentials.

5. Bharatiya Nyaya Sanhita (BNS) & Passports ActBNS Sec. 336 / Passports Sec. 12

Citizens have the lawful right to redact sensitive details on their own documents for privacy. However, altering identity attributes or fabricating false records is prohibited under BNS 2023 Sections 336/338. Under Section 12 of the Passports Act 1967, physical passport booklets must never be defaced; watermarks apply strictly to photocopies/digital scans.
